This User Content and Notice Policy sets out the rules applicable to content created, uploaded, published, transmitted, or otherwise made available by users through the Sportstep platform, as well as the procedure for reporting content that may be unlawful or in breach of this Policy.
This Policy applies together with:
- the Sportstep Terms and Policies;
- the Privacy Policy;
- the Order and Booking Terms;
- any other rules applicable on the Platform, where clearly indicated.
If there is any conflict between this Policy and other Sportstep documents, this User Content and Notice Policy shall prevail in matters relating to content moderation, notices of unlawful content, and user-published content.
1. General Provisions
1.1. The Platform is administered by Sportstep, MB, legal entity code 307605923, registered address Rimvydo g. 15-16, LT-50233 Kaunas, Lithuania, email [email protected], website www.sportstep.lt.
1.2. In this Policy:
a) Sportstep, we, us, our means Sportstep, MB;
b) User means any visitor to the Platform, registered user, client, coach, or other person using the Platform;
c) Content means any information, material, or communication that a User posts, uploads, submits, transmits, or otherwise makes available through the Platform;
d) Platform means the Sportstep website, mobile application, and any current or future Sportstep digital features.
1.3. This Policy applies to all content created or transmitted by users through the Platform, including, without limitation:
a) coach profile descriptions;
b) coach photographs;
c) community posts;
d) comments;
e) replies;
f) other content posted, transmitted, or uploaded by users;
g) all messages that are or will in the future be sent through the Platform’s features.
1.4. By using the Platform and submitting Content, you confirm that you have read, understood, and agree to comply with this Policy.
2. What Content Is Considered User Content
2.1. User Content means all content submitted to the Platform by the user themselves or through their account, including text, photographs, graphic elements, titles, usernames, descriptions, comments, replies, reactions, and other information.
2.2. Content submitted by users is treated as non-confidential to the extent necessary for the operation of the Platform, display, technical processing, storage, moderation, publication, and carrying out actions related to the operation of the Platform.
3. User Responsibility for Content
3.1. The User is solely responsible for all Content submitted by them.
3.2. By submitting Content, the User confirms that:
a) they have the right to post, submit, or transmit such Content;
b) such Content is accurate to the extent that it contains factual statements;
c) where the Content expresses an opinion, that opinion is provided honestly;
d) such Content does not violate laws, third-party rights, Sportstep documents, or this Policy.
3.3. The User also confirms that they have all necessary consents, permissions, and rights where the Content they submit includes other persons’ images, names, data, works, or other protected content.
4. Rights Granted to Sportstep to Use Content
4.1. By submitting Content, the User grants Sportstep a non-exclusive, royalty-free, worldwide license, sublicensable to the extent necessary, to:
a) store;
b) reproduce;
c) display;
d) publish;
e) technically process;
f) format;
g) moderate;
h) use the Content for the operation, administration, security, marketing, and promotion of the Platform and services.
4.2. This right is granted to the extent necessary for the operation of the Platform, the display of Content, moderation, the promotion of Sportstep services, and the enforcement of this Policy.
4.3. Sportstep does not acquire authorship of the user’s work embodied in the Content, but the User grants Sportstep a sufficient license to use the Content in accordance with this Policy.
5. Prohibited Content
5.1. It is prohibited to post, submit, or transmit Content on the Platform that:
a) is unlawful;
b) infringes the intellectual property rights, privacy, dignity, reputation, or other rights of third parties;
c) is false, misleading, or deceptive;
d) creates the impression of impersonating another person;
e) promotes, justifies, or depicts hatred, discrimination, or violence;
f) is threatening, intimidating, insulting, degrading, or harassing;
g) promotes or facilitates unlawful activity;
h) is pornographic, sexual, or otherwise indecent in nature;
i) constitutes spam, unsolicited advertising, or mass solicitation;
j) contains viruses, malicious code, or other harmful technological elements;
k) discloses other persons’ personal data without a lawful basis;
l) otherwise violates laws, accepted standards of morality, or this Policy.
5.2. Content depicting or identifying minors is not permitted on the Platform.
5.3. Sportstep may additionally assess and restrict content that is clearly incompatible with the purpose of the Platform, a safe community environment, or Sportstep’s reputation.
6. Special Rules for Community Content
6.1. Community posts, comments, replies, and other community content must be submitted honestly and must not violate this Policy.
6.2. In community content, it is prohibited to:
a) provide manifestly false information;
b) disclose excessive personal data of other persons;
c) use insulting, discriminatory, or threatening language;
d) use the Platform for advertising, pressure, or blackmail.
6.3. Community posts, comments, replies, and other community content may be additionally supervised through moderation functions operating on the Platform, including actions by the community owner, but the final decision as to whether content remains, is restricted, or is removed is made by Sportstep administration.
6.4. The community owner, where such functionality is provided on the Platform, may remove content and restrict membership in their community in accordance with the Platform rules, but Sportstep administration retains the final moderation right.
7. Sportstep’s Rights in Moderating Content
7.1. Sportstep has the right, at its discretion and to the extent permitted by law and the Platform rules, to:
a) refuse to publish Content;
b) hide Content;
c) restrict the visibility of Content;
d) remove Content;
e) remove a user from a community;
f) temporarily restrict an account;
g) suspend an account;
h) terminate an account;
i) provide information to competent authorities where required by law or by the nature of the situation.
7.2. Sportstep may take such measures where its assessment determines that:
a) the Content is unlawful;
b) the Content breaches this Policy;
c) the Content creates security, reputational, or legal risk;
d) the user is abusing the Platform or the moderation process.
7.3. If a user’s Content is removed or their account is restricted due to Content, Sportstep, where it has the relevant electronic contact details of the user, shall provide a reasoned statement of the decision no later than at the time the decision is implemented.
8. Notices of Potentially Unlawful or Rule-Breaching Content
8.1. If a user believes that Content on the Platform is unlawful or breaches this Policy, they may report it by email to [email protected].
8.2. For a notice to be considered sufficiently substantiated, it must include:
a) a reasoned explanation of why the specific Content is unlawful or breaches this Policy;
b) the precise location of the Content on the Platform, for example a link, screenshot, or other data allowing the Content to be accurately identified;
c) the notifier’s name, surname or company name, and contact details, including email address;
d) confirmation that the notice is submitted in good faith and that the information provided in it is, to the best of the notifier’s knowledge, accurate and complete.
8.3. Sportstep reserves the right to request additional information if the notice is not sufficiently clear, or to leave such notice unexamined if the notifier does not clarify the information or if the information is false.
8.4. Sportstep aims to carry out an initial assessment of the notice within 72 hours, but in complex cases the assessment may take longer, especially where additional information, legal assessment, or involvement of authorities is required.
8.5. In accordance with Article 16 of the Digital Services Act (DSA), Sportstep ensures that the procedure for submitting notices of potentially unlawful content is easily accessible and that received notices are processed without undue delay, diligently, objectively, and impartially.
9. Abuse of the Notice Procedure
9.1. It is prohibited to intentionally submit false, manifestly unfounded, repetitive abusive notices, or notices intended to harm other persons.
9.2. If Sportstep determines that a person is abusing the notice procedure, Sportstep may:
a) reject such notice;
b) restrict that person’s account;
c) temporarily restrict the ability to use certain Platform features;
d) take other reasonable measures in accordance with the Platform rules and applicable law.
10. Review of Decisions
10.1. If a User believes that Sportstep has made an incorrect decision in relation to their Content, they may contact Sportstep by email at [email protected] and request a review of the decision.
10.2. Such request should clearly specify:
a) which decision is being challenged;
b) why the User believes the decision was incorrect;
c) what facts or explanations they consider relevant.
10.3. Sportstep assesses such requests in accordance with this Policy, the Platform rules, the available data, and applicable law.
10.4. The mere fact that the user disagrees with the decision does not in itself mean that the decision will be changed.
11. Information About the Digital Services Act (DSA)
11.1. In accordance with Articles 11 and 12 of the Digital Services Act (DSA), Sportstep designates the following email address as its single point of contact for direct communication with service recipients, the authorities of EU Member States, the European Commission, and other competent authorities: [email protected].
11.2. Sportstep may be contacted at this email address in Lithuanian or English.
11.3. If you wish to report potentially unlawful content on the Sportstep platform, you may do so in accordance with Section 8 of this Policy by email to [email protected].
11.4. If Sportstep receives or otherwise becomes aware of information giving rise to a justified suspicion of a criminal offence being committed or having been committed, Sportstep may provide the information in its possession to competent law enforcement or other authorities to the extent required by law.
12. Data Protection and Confidentiality
12.1. Notices concerning unlawful or rule-breaching content and related information are processed in accordance with the Privacy Policy and applicable data protection laws.
12.2. Sportstep may disclose information about a notice, the notifier, or the author of the content to the extent required by law, by requests of competent authorities, or as necessary to protect Sportstep’s legitimate interests.
13. Liability
13.1. The User is responsible for all consequences arising from the unlawfulness, inaccuracy, or infringement of third-party rights caused by the Content they submit.
13.2. Sportstep takes reasonable moderation measures, but does not guarantee that every potentially unlawful or rule-breaching item of Content will be identified immediately.
13.3. Sportstep is not responsible for the substance of Content submitted by users to the extent that such liability cannot reasonably be attributed to Sportstep under applicable law.
14. Amendments to the Policy
14.1. Sportstep has the right to amend this User Content and Notice Policy if:
a) the functionality of the Platform changes;
b) the types of content or moderation processes change;
c) laws change;
d) other justified operational needs arise.
14.2. The latest version of this Policy will always be published on the Platform.
14.3. If the changes are significant, Sportstep may additionally inform users by email, through their account, or by another appropriate means.
15. Final Provisions
15.1. This User Content and Notice Policy is governed by the laws of the Republic of Lithuania.
15.2. If a person has questions regarding this Policy or wishes to submit a notice or request a review of a decision, they may contact Sportstep by email at [email protected].
15.3. If any provision of this Policy is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
