By using the Sportstep website, mobile application, or any other digital tools related to Sportstep, you confirm that you have read, understood, and agree to comply with these Terms and Policies. If you do not agree with these Terms and Policies, you may not use the Platform.
Before you start using the Platform, and before ordering any third-party services offered through it, please read this document carefully. We recommend that you save a copy for future reference.
I. General Part
1. What Sportstep Is
1.1. Sportstep is a digital platform consisting of the website www.sportstep.lt and a mobile application, hereinafter referred to in this document as the Platform.
1.2. The Platform is administered by Sportstep, MB, legal entity code 307605923, registered office address Rimvydo g. 15-16, LT-50233, Kaunas, Lithuania.
1.3. In this document:
- “Sportstep”, “we”, “us”, “our” means Sportstep, MB;
- “you”, “your” means each visitor to or user of the Platform.
2. What the Platform Is Intended For
2.1. The Platform is primarily intended for consumers and coaches in the Republic of Lithuania.
2.2. The main purpose of the Platform is to:
- enable clients to find coaches, review their profiles, and order the services they offer through the Platform;
- enable coaches and clients to use community, plans, bookings, content, and other related features.
2.3. The Platform may provide general information about sports, physical activity, nutrition, and well-being. Such information is not considered medical or other professional healthcare advice unless expressly stated otherwise.
2.4. Unless expressly stated otherwise, Sportstep itself does not provide coaching, healthcare, or other third-party services offered through the Platform, but operates as a digital platform enabling users to access the Platform’s features and order third-party services through it.
II. Scope of This Document
3. What These Terms and Policies Regulate
3.1. This document sets out the general rules under which you are granted access to the Platform and its features.
3.2. These Terms and Policies include:
- your right to use the Platform;
- the general principles of data processing and storage, the detailed procedures of which are set out in the Privacy Policy;
- the general principles applicable to services ordered through the Platform and content published by users;
- other rules or additional terms that may in certain cases be presented on the Platform or in separate documents.
3.3. In this document, the term “Terms and Policies” includes these general terms of use of the Platform, the Privacy Policy, and any other additional rules or conditions that may be published on the Platform or in separate documents for specific Platform features.
3.4. The cooperation relationship between Sportstep and coaches or other partners is not regulated in detail in this document to the extent that it is governed by separate cooperation terms for coaches or partners.
3.5. If competitions, promotions, special offers, or loyalty programs are organized on the Platform, additional rules may apply to them. If such rules conflict with this document, the specific rules shall prevail in the relevant case.
4. Changes to the Document
4.1. Sportstep has the right to periodically amend these Terms and Policies.
4.2. The latest version is always published on the Platform.
4.3. We recommend that you review this document regularly. If you continue to use the Platform after an updated version has been published, you will be deemed to have accepted the updated version, unless applicable law requires explicit additional consent.
III. Use of the Platform
5. General Rules of Use
5.1. These rules of use apply to all ways of using the Platform, including use through a web browser, mobile application, or other digital devices.
5.2. If you do not agree to these rules, you may not use the Platform.
5.3. The Platform and its features may be modified, updated, temporarily restricted, suspended, or discontinued at our discretion if necessary for technical, security, legal, or other justified reasons.
5.4. Access to the Platform is provided on a temporary basis. We do not assume responsibility for the possibility that the entire Platform or any part of it may be unavailable at any given time.
5.5. You are solely responsible for ensuring that you have all technical means necessary to access and use the Platform.
6. Prohibited Conduct
6.1. The Platform must be used lawfully, fairly, and in accordance with its intended purpose.
6.2. You are prohibited from:
- distributing viruses, malicious code, or other harmful technological material;
- unlawfully accessing or attempting to unlawfully access the Platform, its servers, databases, or related systems;
- interfering with the operation of the Platform or attempting to damage it by technical means;
- collecting, copying, or otherwise using the Platform’s content or data for unauthorized purposes;
- using the Platform in violation of laws, third-party rights, or accepted standards of morality.
6.3. If you breach these provisions, Sportstep has the right to restrict or terminate your access to the Platform, remove content, suspend your account, or take other reasonable measures.
IV. Registration and User Accounts
7. Registered Users
7.1. A person who is at least 18 years old may create an account and become a user of the Platform.
7.2. Certain Platform features may be available only to registered users.
7.3. By registering, you confirm that all information you provide is accurate, correct, and up to date.
7.4. You are responsible for maintaining the confidentiality of your login details and for all actions carried out through your account, except where the account was used without your fault.
7.5. Sportstep has the right to restrict, suspend, or terminate an account if it reasonably believes that:
- false information has been provided;
- these Terms and Policies are being violated;
- the Platform is being used unfairly;
- there is a security, fraud, or other significant legal risk.
7.6. A user may at any time initiate deletion of their account through the Platform, including through the mobile application. Once this action is completed, the user’s account is removed from active use, and the user can no longer log in to the account or use the Platform features associated with it.
7.7. If the user wishes to have all of their personal data fully erased, they must submit a separate request to Sportstep using the contacts specified in these Terms or in the Privacy Policy. Upon receiving such a request, Sportstep will, without undue delay, assess the request and erase personal data whose further retention is no longer necessary or has no other lawful basis.
7.8. Certain data may be retained even after account deletion if its retention is necessary under applicable law, payment and accounting requirements, for dispute resolution, for the establishment, exercise, or defense of legal claims, or on other lawful grounds. In such cases, the data will be retained only to the extent necessary and only for as long as required by law or by Sportstep’s legitimate interests.
8. Coach Accounts
8.1. If you use the Platform as a coach, certain coach-specific features may be subject to additional conditions, including profile review, approval, or other separately established rules.
8.2. Sportstep may review the profile, documents, or other information submitted by a coach and decide whether to approve the coach’s profile.
8.3. If the Platform uses a verified coach badge or similar status, this only means that Sportstep has reviewed certain information or documents provided by the coach in accordance with its internal procedures. Such designation is not an absolute guarantee of the coach’s qualifications, reputation, quality of services, or any specific result.
V. User Content and Intellectual Property
9. User-Generated Content
9.1. If the Platform’s features allow it, users may post comments, posts, reactions, and other content.
9.2. You are responsible for all content you post and confirm that:
- you have the right to post it;
- such content does not violate laws, the rights of other persons, or these Terms and Policies.
9.3. By posting, uploading, or otherwise submitting content on the Platform, you grant Sportstep a non-exclusive, royalty-free, limited right to use, store, display, technically process, and copy such content to the extent necessary for the operation of the Platform, the display of content, moderation, security, and enforcement of these Terms.
9.4. If the content you post or upload contains other persons’ data, images, photographs, videos, or other protected subject matter, you confirm that you have the right to post such content and assume responsibility for its lawfulness.
9.5. Sportstep has the right to refuse to publish, restrict, hide, or remove user content if, in our assessment, it violates laws, these Terms and Policies, or the User-Generated Content Policy.
9.6. Opinions expressed in user content are the opinions of the users themselves and do not necessarily reflect the position of Sportstep.
9.7. If you believe that content on the Platform violates your rights, is unlawful, or is otherwise inappropriate, you may notify us by email at [email protected] or by other means indicated on the Platform. Upon receiving such notice, we will review the relevant content and take reasonable action in accordance with applicable laws and internal rules.
10. Sportstep’s Rights to the Platform
10.1. All rights to the Platform, its design, structure, source code, texts, marks, logos, graphics, databases, and other Platform content, except for user-generated content, belong to Sportstep or lawful license holders.
10.2. You are granted a limited, personal, non-exclusive, and revocable right to use the Platform solely for its intended purpose.
10.3. Without Sportstep’s prior written consent, it is prohibited to copy, distribute, sell, modify, publicly publish, or otherwise commercially use the Platform or its content, except where expressly permitted by law.
11. Trademarks and Links
11.1. The Sportstep name, domain, logo, and other marks related to the Platform are protected in accordance with applicable law.
11.2. Other trademarks, product names, or company names mentioned on the Platform may belong to their respective owners.
11.3. You may place links to our website for non-commercial purposes, provided that you do so lawfully, fairly, and without harming our reputation.
11.4. You may not create the impression that Sportstep endorses, supports, or is otherwise associated with your website, product, or service without Sportstep’s written consent.
11.5. You may not frame our Platform content or otherwise use the Platform in a way that infringes our rights or the rights of third parties.
11.6. Sportstep has the right to withdraw permission to place links to the Platform at any time.
VI. Privacy, Third Parties, and Liability
12. Privacy and Cookies
12.1. It is important to us that your personal data is processed lawfully, fairly, and transparently.
12.2. Information about how we process your personal data, what rights you have, and how we use cookies and similar technologies is provided in our Privacy Policy and Cookie Policy. In accordance with the General Data Protection Regulation (GDPR), we always strive to ensure that the information provided to data subjects is clear, transparent, and easily accessible.
13. Third-Party Services and Websites
13.1. The Platform may contain information, links, advertising messages, or service offers provided by third parties.
13.2. Services of coaches or other service providers may be offered through the Platform. Unless expressly stated otherwise, the relevant coach or other service provider is responsible for the content, performance, quality, and suitability of such services.
13.3. If the Platform contains links to third-party websites or services, you use them at your own risk. We are not responsible for the content, information, services, or applicable rules of such third parties.
13.4. If you access a third-party website or use a third-party service, our Terms and Policies will no longer apply to such use.
14. Limitation of Liability
14.1. To the extent permitted by applicable law, the Platform is provided on an “as is” and “as available” basis.
14.2. Sportstep does not guarantee that the Platform will always operate without interruption, be completely secure, be completely accurate, or always be available.
14.3. Sportstep also does not guarantee any specific athletic, physical, wellness, or other result that may be associated with a coach’s services or information provided on the Platform.
14.4. You are solely responsible for your decision to use information provided through the Platform, as well as training, nutrition, or other recommendations and third-party services, taking into account your individual health condition, physical fitness, and other relevant circumstances.
14.5. To the extent permitted by law, Sportstep is not liable for:
- indirect or consequential losses;
- loss of data, income, profit, or business opportunities;
- actions or omissions of coaches or other users, or the information or services they provide;
- the operation of third-party services or websites.
14.6. Nothing in these Terms and Policies limits Sportstep’s liability in cases where such liability cannot be limited under the laws of the Republic of Lithuania.
VII. Final Provisions
15. Territory and Governing Law
15.1. The Platform is intended for the Lithuanian market and is primarily designed for users in the Republic of Lithuania.
15.2. If the Platform is used from other countries, this is done at the user’s own risk and responsibility.
15.3. These Terms and Policies are governed by the laws of the Republic of Lithuania.
16. Complaints and Disputes
16.1. If you have a complaint regarding the Platform or the application of these Terms and Policies, we kindly ask that you first contact us in writing by email at [email protected].
16.2. If you are a user of the Platform and you are not satisfied with our response, or do not receive one within the statutory period, you have the right to apply to the State Consumer Rights Protection Authority (hereinafter – VVTAT) for out-of-court resolution of a consumer dispute.
16.3. All disputes that cannot be resolved amicably or out of court shall be resolved in accordance with the laws of the Republic of Lithuania.
